Why are Hardhats Required at Some Worksites?
There are a couple of related reasons for the requirement.
The first is that, in some instances, hardhats are required by law. There exists a Federal agency, OSHA, which is the acronym for the Occupational Safety and Health Administration. OSHA began operating in 1971 with the enactment of the Occupational Safety and Health Act. It is administered by the U.S. Department of Labor (DOL). The stated mission of OSHA is to “assure safe and healthful working conditions for working men and women by setting and enforcing standards and enforcing standards and by providing training, outreach, education and assistance”1. One of the subjects addressed by OSHA is protective equipment, of which hardhats are a type. Hardhats are specifically addressed by the Act at Title 29 ss.1910.135 of the United States Code.
The Act covers most private and some public employers; some States have OSHA-approved health and safety programs. Those that do are monitored by Federal OSHA and must be at least as effective as Federal OSHA. Much of OSHA consists of requirements placed upon employers to ensure safety practices. Other aspects bestow rights upon employees to report violations and enjoy the protections of the law without retribution.
The other reason for the requirement of hardhats at some worksites relates to the very nature of the trauma to which an individual may be exposed. Hardhats are specifically addressed by OSHA because of the risk of concussions, traumatic brain injuries (TBI’s) and mild brain injury (MBI) that can result from a work-related injury.
Hardhats, like other forms of headgear, are not foolproof. Catastrophic injuries can still occur despite their use. When that happens, it is important to know that after appropriate acute care, post-acute rehabilitation will be necessary. When an individual emerges successfully from acute care and sub-acute care, he or she enters the post-acute stage of care. The goal of post-acute rehabilitation is to allow the individual to regain independence to the fullest extent of his or her physical and mental ability.
